It's the 4th quarter stretch...

of the Federal Government's Fiscal Year (FY) 2023 (or End of FY (EOFY)), the time when Federal agencies are looking to use their remaining budgets to purchase as many goods and services as they can before closing out their books for the year. From the outside the process can seem like a chaotic and unorganized spending frenzy. From the inside, it's a frenzy… but not without its rules. In this issue, we will look at the types of funds agencies work with and how they can be used, particularly at this time of year.

 

We also continue our series on the Service Contract Labor Standards (SCLS, formerly known as the Service Contract Act) and get into exemptions for certain services and individuals along with the governing statutes, regulations, and criteria that must be met. While it may seem like you can pick exemptions out easily based on labor categories, it’s not just about job titles as you’ll soon see.

SBA's FY22 Small Business Procurement Scorecard - Grading Government

The Government garnered an "A" grade for FY22 while continuing to miss several prime and subcontracting goals. While more money went into the hands of small businesses overall, the percentage of total dollars was still less than the Government's goal and the number of small business prime contractors decreased across four categories of small businesses.

 

Prime Contract Awards: WOSBs: goal 5%; actual 4.57%

HUBZone SBs: goal 3%; actual 2.65%

 

Subcontracting: SDBs: goal 5%, actual 4.55%

SDVOSBs: goal 3%, actual 2.16%

HUBZone SBs: goal 3%, actual 1.68%

Appropriated Funds & Federal Contracting

There is a constant accounting and review of all appropriated funds that continues until right up until the clock strikes twelve on the night of every September 30th to ensure funds are fully utilized. This “ritual dance” has a direct effect on when projects are solicited, and which contracts are awarded.
