Considering the Canadian Summer Jobs Program? 

The Canadian Summer Jobs program provides funding to Canadian small businesses and non-profit organizations to hire young individuals for summer work. Private sector employers with 50 or fewer employees may be able to receive a subsidy which could cover up to 50% of the provincial minimum wage for the duration of the placement. Non-profit employers could potentially receive 100% of the minimum wage.

If you are planning to hire temporary summer workers this year, please consider this program. The application deadline for this fund is January 25, 2019.

Ontario Corporations : Reminder that the Deadline to Have Your Real Property Register is December 10, 2018

In December 2016, new record keeping obligations were created by way of amendments to the Ontario Business Corporations Act; the Ontario Corporations Act, and the Ontario Not-for-profit Corporations Act, 2010.

 

These specific record keeping obligations under the Ontario Business Corporations Act (OBCA) already apply to all Ontario Corporations which were incorporated on or after December 10, 2016. For the Ontario corporations which were incorporated before this date, a two year grace period was provided to make these changes; the deadline now being December 10, 2018.

 

Under the OBCA amendments, the register of a corporation's ownership interests in land in Ontario must be kept at the registered office of the corporation, identify each property owned by the corporation, as well as show the date which the property was acquired and if applicable, the date that the property was disposed.

 

It is also required that the register keep any deeds, property transfers, or similar documents that contain any of the following items regarding each property that is listed:

The municipal address, The Registry or Land Titles Division as well as the property identifier number, the legal description, and the assessment roll number (if applicable.)

 

Failure to comply to these new provisions could trigger large fines and even jail time.

The requirements to post and distribute this poster is as follows (please note the requirements to post have not yet changed):

 

  • the most recent copy of the ESA poster (Version 8.0) must be posted in a conspicuous place where it is likely to come to the attention of employees
  • a copy of the most recent poster must be given to each employee
  • a copy of the poster must be provided to each new hire within 30 days of their hiring date
  • post a copy of the poster in English, but if the majority language spoken in the workplace is other than English and the MOL has published a poster in that language, a copy of that poster is to be displayed alongside the English version.

 

Failure to post the most recent version, or failure to comply with the posting obligations that were listed is a violation of the Employment Standards Act, 2000. The listed obligation to provide all employees with a copy can be met by either providing a physical copy, an electronic copy or by other electronic means in which case the employee is directed to the poster by link and is able to print it.

 

*Please note that Bill 66, which has not yet passed; would remove the obligation for employers to post in the workplace. It is expected that the final reading of this Bill will be on February 19. In the meantime, the above obligations must be met.
