Focus in FY25!

 

While the first quarter of a new FY can be a little slow in terms of new opportunities being announced, now is the perfect time for you to identify your FY25 goals in the Federal marketplace and build a plan of action. There is a lot of noise in the Federal marketplace. Focusing on your goals and plan will help you cut through it.

FAR Case 2023-007, Limitation of Authority Regarding Extraordinary Contractual Actions -- Increases the Congressional committee notification threshold to $150 million. No new requirements on primes or subcontractors from this rule. Final Rule Effective: 8/29/2024 (FAC 2024-06)

 

FAR Case 2025-005, Reference to Penalty Threshold -- Updates the civil penalties language in FAR provision 52.2023-11(e) to match FAR clause 52.203-12(e). No new requirements on primes or subcontractors from this rule. Final Rule Effective: 9/30/2024 (FAC 2024-07)

 

FAR Case 2021-009, Protests of Orders Set Aside for Small Business -- Implements several SBA final rules to update and clarify requirements, processes, and procedures associated with size and socioeconomic status protests in connection with multiple-award contract set-asides and reserves, and orders placed under multiple-award contracts. Final Rule Effective: 8/29/2024 (FAC 2024-06)

 

FAR Case 2015-038, Reverse Auction Guidance -- Amends FAR to address agencies' use of reverse auctions and issues Governmentwide guidance to maximize competition and saves when using reverse auctions. Final Rule Effective: 8/29/2024 (FAC 2024-06)

 

DFARS Case 2022-D023, Data Universal Numbering System to Unique Entity Identifier Transition - Aligns DFARS with FAR regarding the transition from the DUNS number to the UEI. Final Rule Effective: 10/1/2024

 

DFARS Case 2022-D014, Modification of Prize Authority For Advanced Technology Achievements - Authorizes DoD to carry out advanced technology prize programs to award contracts to recognize outstanding achievements in basic, advanced, and applied research; technology development; and prototype development. Final Rule Effective: 10/1/2024

 

DFARS Case 2022-D013, Assuring Integrity of Overseas Fuel Supplies - Creates a new DFARS provision in which offerors must certify that the fuel (or derivatives of the fuel) to be provided will not be sourced from a nation or region prohibited from selling petroleum to the U.S. Final Rule Effective: 10/1/2024

 

DFARS Case 2021-D020, Preference for United States Vessels in Transporting Supplies By Sea - Clarifies when DoD may waive the requirement for DoD supplies to be transported by sea in either vessels belonging to the U.S. or vessels of the U.S. Final Rule Effective: 10/1/2024

 

DFARS Case 2020-D026, Modification of Notification of Intent to Transport Supplies By Sea - Streamlines required notifications of transportation of supplies by sea, reducing the number of representations offerors must provide. Final Rule Effective: 10/1/2024

 

GSAR Case 2020-G510, FSS Economic Price Adjustment (EPA) (Final Rule) -- Amends GSA's FAR Supplement (GSAR) to consolidate the four FSS EPA clauses into a single schedule clause 552.238-10 Economic Price Adjustment - Federal Supply Schedule Contracts, memorializing GSA's moratorium on EPA adjustments effective since March 2022 and now making it permanent. Final Rule Effective: 9/4/2024

DFARS Case 2024-D007 Preventing Conflicts of Interest for Certain Consulting Services (Proposed Rule) -- Would implement a prohibition for DoD from awarding contracts assigned a NAICS code beginning with 5416 to offerors who hold contracts that involve consulting services with certain covered foreign entities and requires that if an offeror in a covered NAICS has such contractual relationships, they must submit a conflict of interest mitigation plan to be incorporated into any resulting contract.

DFARS Case 2022-D004 DoD Cost or Pricing Data Reporting Requirements (Proposed Rule) -- Would require offerors to submit data other than certified cost or pricing upon contracting officer request, establish a $2 million threshold for the Truthful Cost or Pricing Data statute requirements with respect to mods, subcontracts, and mods to subcontracts, and require implementation into contracts as soon as practicable.

DFARS Case 2020-D028 Public Access to Results of Federally Funded Research (Proposed Rule) -- Proposes two new clauses that require contractors that include fundamental research to develop and maintain a data management plan and submit final peer-reviewed manuscripts to the Defense Technical Information Center's publicly accessible repository.

DFARS Case 2019-D041 Assessing Contractor Implementation of Cybersecurity Requirements (Proposed Rule) -- Would implement the requirements of CMMC 2.0 in contracts through changes to update existing language to match that guidance to include revisions to the existing DFARS clause 252.204-7021, Cybersecurity Maturity Model Certification Requirements.

SBA HUBZone Program Updates and Clarifications and Clarifications to Other Small Business Programs (Proposed Rule) -- Proposes numerous changes that impact nearly every socioeconomic program and the certification requirements of each.
